Shots fired after son threatens mother

AULANDER – Hertford County Sheriff’s investigators have determined that a local woman acted in self defense when she fired shots at her 41-year-old son.
Sheriff Dexter Hayes said his deputies were dispatched on July 23 to a residence on Askew Lane near Aulander in response to a shooting. Upon arrival, deputies discovered it was a domestic violence incident involving a mother and her son, both of whom resided at the location.
Deputies found the son, Alvin Hinata III, on the floor with a gunshot wound to his legs. They provided first aid until Hertford County EMS arrived and transported him to ECU Roanoke-Chowan Hospital for treatment.
After his release from the hospital, Hinata was arrested for one count each of assault with a deadly weapon, assault on a female, and communicating threats.
The mother stated that her son had repeatedly threatened to kill her and had produced a knife. In self defense, Ms. Hinata used her handgun to shoot her son.
“She also noted that her son suffers from mental illness and refuses to take his medication,” Hayes said. “The investigation of this incident is concluded with no charges filed against Ms. Hinata for the shooting.”
